5. Photography, Images & Content Usage

Copyright Ownership

Glean & Co Photography retains all copyright and intellectual property rights to all photographs created during your session. This is true whether or not you purchase images.

What You Receive When You Purchase Images

When you purchase selected images from your session, you receive:
  • Personal Use License: A non-exclusive license to use, print, and display the purchased images for your personal, non-commercial use
  • Digital Files: Digital copies of the purchased images (if applicable to your package)
  • Rights to Copy: The right to make personal copies and prints of purchased images for your own use

Restrictions on Your License
For purchased images, you may NOT:
  • Use images for commercial purposes or profit
  • Sell, license, or resell the images
  • Reproduce images in bulk or publish in professional contexts without permission
  • Edit or modify images (beyond personal use adjustments)
  • Remove or alter any copyright information or watermarks

Images You Do NOT Purchase
For images from your session that you do not purchase:
  • Glean & Co retains complete ownership and copyright
  • You do not have rights to use, copy, print, or distribute these images
  • Glean & Co may use these images for portfolio, social media, marketing, and any other business purpose

Glean & Co's Rights to Images
Regardless of whether you purchase images, Glean & Co retains the right to:
  • Display all images on our website, portfolio, and social media
  • Use images in advertising, marketing campaigns, and promotional materials
  • Feature images on Instagram, Facebook, and other social media platforms
  • Use images in business blogs, case studies, and educational content
  • Display images in print and digital advertising

Opting Out of Marketing Use
If you prefer that Glean & Co not use your images in marketing, portfolio, or advertising, please inform us in writing during your pre-session consultation or booking process. We will respect your request and not feature your images in public-facing marketing channels.

Note: Opting out of marketing use does not affect copyright ownership. Glean & Co retains all copyright to both purchased and unpurchased images.

6. Data Protection & Security

Security Measures
We implement industry-standard security measures to protect your information:

  • Encryption of sensitive data transmitted over the internet (HTTPS/SSL)
  • Secure storage of financial information
  • Access controls limiting who can view personal information
  • Regular security audits and updates
  • Confidentiality agreements with employees and service providers

However, no security system is completely secure. We cannot guarantee absolute security of your information. You are responsible for maintaining the confidentiality of your passwords and account information.

Data Access
Only employees and service providers who need access to personal information to perform specific functions (customer service, billing, marketing, editing) are granted access. All staff are bound by confidentiality agreements.

3. How We Use Information

We use the information we collect for the following purposes:
  • Service Delivery: To provide photography services, manage bookings, deliver edited photos, process payments, and provide customer support
  • Communication: To send session reminders, delivery notifications, and respond to your inquiries
  • Marketing: To send promotional offers, newsletters, and announcements (only to those who have opted in)
  • Personalization: To personalize your experience and customize content based on your preferences
  • Business Improvement: To understand client needs, improve our services, and develop new offerings

4. Marketing Communications & SMS/Email Opt-In

Email Marketing
We send promotional and informational emails to subscribers who have opted in. Email communications may include:
  • Photography tips and educational content
  • Special promotions and session discounts
  • Announcements about new services or products
  • Newsletter updates and business announcements
  • Transactional emails (booking confirmations, delivery notifications, receipts)

SMS/Text Message Marketing
We offer SMS communications to clients who have opted in by checking 2 separate boxes  on the contact form on our website for 1. notification and 2. promotional messages. SMS communications may include:
  • Session reminders and booking confirmations
  • Special offers and promotional messages (up to 4 per month) 
  • Important service updates and announcements
  • Transactional messages related to your bookings
  • SMS Compliance: We comply with the Telephone Consumer Protection Act (TCPA) and all state regulations. Message and data rates may apply. Standard SMS rates from your wireless carrier may be charged.

SMS Communications - Opt-In & Consent
When you opt in to receive SMS/text messages from us:
- We will send transactional messages (booking confirmations, session reminders, photo delivery notifications) and occasional promotional messages to the mobile number you provide
- Transactional message frequency depends on your booking schedule and may vary from none to several messages in a week around your session dates
- Promotional messages are sent no more than 1-2 times per month
- Standard message and data rates apply
- You may opt out at any time by replying "STOP" to any message
- You can text "HELP" for assistance
- We use Twilio via Go High Level to deliver these messages

Opting In & Managing Preferences
Email and SMS communications require your explicit, affirmative consent. You may:
  • Complete our SMS & Email Consent Form to opt in
  • Select communication preferences during booking
  • Contact us to update your preferences at any time

Opting Out
You can opt out of marketing communications at any time:
  • Email: Click the "Unsubscribe" link at the bottom of any email, or contact us at hello@gleanandco.com
  • SMS: Reply STOP to any text message. We will confirm your unsubscribe and stop sending within 24 hours (except for one confirmation message)
Note: Opting out of marketing messages does NOT affect transactional messages (booking confirmations, session reminders, photo delivery notifications).

Information You Provide Directly
We collect information that you manually provide to us, including:

  • Booking Information: Session type, date preferences, special requests, and other details provided when scheduling
  • Financial Information: Credit card, bank account, or payment information when processing payments

  • Demographic Information: Age range, location, and other details you share

This Privacy Policy applies to all users of this website and services provided by Glean and Co Photography, LLC ("Glean & Co," "we," "us," or "our"). By using our website, booking services, or providing information to us, you are agreeing to comply with and be bound by this Privacy Policy.

7. Data Retention Schedule
We retain different types of information for different periods based on business need and legal requirement:
  • Booking & Session Data: 3-5 years (for tax/legal purposes)
  • Client Photos (originals & edits): Indefinitely (for portfolio & archival purposes)
  • Email/SMS Consent Records: Minimum 3 years (TCPA compliance)
  • Opt-Out Records: Minimum 3 years
  • Website Analytics: Up to 38 months (Google Analytics default)
  • Email List (inactive): 6 months after opt-out/inactivity

Photography Sessions With Children
  • When a minor (under 18) participates in a photography session:

  • If we become aware that we have collected information from a child under 13 without proper consent, we will delete that information promptly.
